Google pledges to only use open-source related patents defensively

Google has taken to its Open Source Blog today to announce that it is creating a new pledge to never use its patents related to open-source software unless attacked first.

The new pledge, officially named the "Open Patent Non-Assertion Pledge" (or OPN Pledge for short), indicates that unless otherwise attacked by another creator of open-source software, Google will not use its patents against any other entity. The entire pledge runs a few paragraphs (and can be seen at the source link below), but the idea is that Google wants to be able to hold patents to protect itself (and software) from attack while agreeing to not attack themselves. A small excerpt from the pledge reads:

It is Google’s intent that the Pledge be legally binding, irrevocable (except as otherwise provided under “Defensive Termination” below) and enforceable against Google and entities controlled by Google, and their successors and assigns.

Meaning that not only does the pledge apply to Google's own operations, but also those of any company owned or operated by it -- such as Motorola, presumably -- as well as any company that buys or sells patents with Google. The pledge states that any company receiving patents from Google must agree to the terms of the pledge in their own use, and also have similar requirements if it were to ever transfer the patents again to a third entity.

It is worth noting that the OPN Pledge only applies to other entities that are also making open-source software, and makes no mention that Google's patents couldn't be used offensively against one making closed-source software. And while Motorola presumably falls under the category of "entities controlled by Google", because it is technically being run as an independent company we're unsure on how this pledge affects it.

Reiterating that it believes that open internet and open software systems are the best choice for everyone, Google is hoping that the OPN Pledge "will serve as a model for the industry". It also notes the devotion to open-source software by other entities like IBM and Red Hat, which are said to be examples for what the OPN Pledge was built on.

(AP) ? The Obama administration proposed new regulations Friday to clean up gasoline and automobile emissions, claiming the new standards would provide $7 in health benefits from cleaner air for each dollar spent to implement them. The costs likely would be passed on to consumers in higher gasoline and automobile prices.

The Environmental Protection Agency said the new rule would reduce sulfur in gasoline and tighten automobile emission standards beginning in 2017, resulting in an increase in gas prices of less than a penny per gallon. The agency estimated it also would add $130 to the cost of a vehicle in 2025, but predicted it would yield billions of dollars in health benefits by slashing smog- and soot-forming pollution.

EPA Acting Administrator Bob Perciasepe said the proposal is designed to "protect the environment and public health in an affordable and practical way."

The oil industry, Republicans and some Democrats wanted EPA to delay the rule, citing higher costs. An oil industry study says it could increase gasoline prices by 6 to 9 cents a gallon.

"Consumers care about the price of fuel, and our government should not be adding unnecessary regulations that raise manufacturing costs, especially when there are no proven environmental benefits," said Bob Greco, an American Petroleum Institute official. "We should not pile on new regulations when existing regulations are working."

Environmentalists hailed the proposal as potentially the most significant in President Barack Obama's second term.

The so-called Tier 3 standards would reduce sulfur in gasoline by more than 60 percent and reduce nitrogen oxides by 80 percent, by expanding across the country a standard already in place in California. For states, the regulation would make it easier to comply with health-based standards for the main ingredient in smog and soot. For automakers, the regulation allows them to sell the same autos in all 50 states.

The Obama administration already has moved to clean up motor vehicles by adopting rules that will double fuel efficiency and putting in place the first standards to reduce the pollution from cars and trucks blamed for global warming.

"We know of no other air pollution control strategy that can achieve such substantial, cost-effective and immediate emission reductions," said Bill Becker, executive director of the National Association of Clean Air Agencies. Becker said the rule would reduce pollution equal to taking 33 million cars off the road.

But the head of American Fuel and Petrochemical Manufacturers, Charles Drevna, questioned the motives behind the agency's regulation, since refining companies already have spent $10 billion to reduce sulfur by 90 percent. The additional cuts, while smaller, will cost just as much, Drevna said, and the energy needed for the additional refining actually could increase carbon pollution by 1 percent to 2 percent.

"I haven't seen an EPA rule on fuels that has come out since 1995 that hasn't said it would cost only a penny or two more," Drevna said.

A study commissioned by the American Petroleum Institute estimated that lowering the sulfur in gasoline would add 6 cents to 9 cents a gallon to refiners' manufacturing costs, an increase that likely would be passed on to consumers at the pump. The EPA estimate of less than 1 cent is also an additional manufacturing cost and likely to be passed on.

A senior administration official said Thursday that only 16 of 111 refineries would need to invest in major equipment to meet the new standards, which could be final by the end of this year. Of the remaining refineries, 29 already are meeting the standards because they are selling cleaner fuel in California or other countries, and 66 would have to make modifications.

The official spoke on condition of anonymity because the rule was still undergoing White House budget office review.

Hockey helps Canada's economy grow again in January

OTTAWA (Reuters) - Canada's economy bounced back from a year-end slump in January thanks to factories, mines and the return of professional ice hockey, but growth still looks too weak to match the central bank's upbeat outlook and interest rates are unlikely to budge until 2014.

Gross domestic product expanded by 0.2 percent in the month, Statistics Canada said on Thursday, following the weakest two quarters since the 2008-09 recession and a 0.2 percent contraction in December.

A comeback in the manufacturing sector helped spark the turnaround, along with strength in the mining and energy sectors and the delayed start of the country's beloved hockey season after National Hockey League players and owners settled a months-long labor dispute.

The data suggests the economy is starting the year on a more solid footing after disappointing 0.6 percent annualized growth in the fourth quarter.

But economists are betting the first quarter will fall far short of the central bank's projected 2.3 percent growth.

"Once the darling of advanced economies, Canadian economic growth is expected to converge to be more in line with its peers," said Mazen Issa, macro strategist at TD Securities.

Canada recovered much more quickly from the 2008-09 recession than did the United States and others but has been spinning its wheels for several months as exports and manufacturing sputtered.

That has forced the Bank of Canada to acknowledge there is more slack in the economy than it had anticipated. As a result, it has gradually softened its talk of an interest rate increase, and this month said rates will remain on hold "for a period of time".

Issa said the January report was in line with TD's forecast of 1.6 percent growth in the first three months of the year, "and the broader narrative of a gradual grind higher over the course of the year."

The central bank will publish updated forecasts alongside its next interest rate decision on April 17.

Manufacturing expanded 1.2 percent in January as gains in fabricated metals and wood products offset a decline in transportation equipment.

The mining, quarrying and oil and gas extraction industry expanded 0.2 percent, while the arts and entertainment sector got a one-time boost of 4.1 percent as Canadians flocked to hockey arenas and sports pubs after the NHL labor dispute ended.

Players and owners reached a deal in January to end a four-month lockout of players. Canada has NHL teams in Vancouver, Calgary, Edmonton, Winnipeg, Toronto, Ottawa and Montreal.

Industries that shrank in January included agriculture and forestry, construction, and finance and insurance.

In a separate report, Statscan said Canadian industrial product prices increased 1.4 percent in February from January, the biggest jump since June 2008 as prices for petroleum, coal and other commodities charged higher.

The Canadian dollar hit its strongest level in more than a month - at C$1.0145 versus the U.S. dollar, or 98.57 U.S. cents - immediately after the release of data. It later retreated and was little changed from Wednesday's North American close of C$1.0165, or 98.38 U.S. cents.

The solid GDP report along with an inflation rate that is below the Bank of Canada's 2 percent target has confirmed market expectations that the bank will hold rates at the current 1.0 percent until 2014.

"We're looking at possible downward growth revisions from the BoC again ... alongside slightly higher spare capacity estimates. We continue to expect an incrementally more dovish Monetary Policy Report in a couple of weeks," said Derek Holt, economist at Scotiabank.

Global forecasters surveyed by Reuters in February predicted the next rate hike will be in the first quarter of 2014. However, traders are pricing in a slight bias towards a rate cut later this year, based on yields on overnight index swaps, which trade based on expectations for the policy rate.

PST: Donovan returns, wants back in US team

Landon Donovan?s first meeting with reporters in months is over, and the U.S. national team?s all-time leading scorer had lots of interesting things to say.

Donovan answered questions after Thursday?s Galaxy practice at the Home Depot Center in his first get-together with members of the press since December; he went on sabbatical and more or less disappeared from public view after the MLS Cup post-game news conference four months ago.?(Donovan did have some public comments relayed recently through the magic of citizen journalism?last month.)

Donovan is saying all the right things, not just about the Galaxy but also about the U.S. national team. (It?s almost surreal, isn?t it, to think that the program?s all-time leading scorer and noted Mexican team killer was just one of us, just another Joe watching from the States as USMNT did proper battle in Mexico City?)

Donovan spoke with candor, respect and humility about his place with the Galaxy and the U.S. national team, and of his personal relationships with the respective managers, Bruce Arena and Jurgen Klinsmann. For instance, in discussing his conversations with Arena:

Understandably, no coach wants to lose one of their players for three months, or a few months of the season. At first, Bruce wasn?t ecstatic about it, but I?ve known Bruce a long time and I think he understood pretty clearly how passionate I was about needing this break and now I think everyone can agree that it was absolutely needed and the right thing to do.

Donovan talked about the need to work his way back into both teams, with absolutely no sense of entitlement, certainly the correct attitude considering that both teams have gone through periods of transition or (in the U.S. case) pretty rough times during the period of his absence.

Donovan still wants to get back on the field in early April. Looking at the Galaxy schedule, would it surprise anyone to see Donovan make an appearance off the bench during the team?s April 3 home leg of the CONCACAF Champions League semifinal series against Monterrey? (Depending on what the match looks like over last 20 or so minutes, naturally.)

Meanwhile, teammates certainly seem happy to have their wise, quick attacker back on the field. Galaxy left back Todd Dunivant, a good friend of Donovan?s in addition to his longtime teammates, says Donovan may even make an impact quicker than people think.

Uncovering Africa's oldest known penguins

Africa isn't the kind of place you might expect to find penguins. But one species lives along Africa's southern coast today, and newly found fossils confirm that as many as four penguin species coexisted on the continent in the past. Exactly why African penguin diversity plummeted to the one species that lives there today is still a mystery, but changing sea levels may be to blame, the researchers say.

The fossil findings, described in the March 26 issue of the Zoological Journal of the Linnean Society, represent the oldest evidence of these iconic tuxedo-clad seabirds in Africa, predating previously described fossils by 5 to 7 million years.

Co-authors Daniel Thomas of the National Museum of Natural History and Dan Ksepka of the National Evolutionary Synthesis Center happened upon the 10-12 million year old specimens in late 2010, while sifting through rock and sediment excavated from an industrial steel plant near Cape Town, South Africa.

Jumbled together with shark teeth and other fossils were 17 bone fragments that the researchers recognized as pieces of backbones, breastbones, wings and legs from several extinct species of penguins.

Based on their bones, these species spanned nearly the full size spectrum for penguins living today, ranging from a runty pint-sized penguin that stood just about a foot tall (0.3 m), to a towering species closer to three feet (0.9 m).

Only one penguin species lives in Africa today ? the black-footed penguin, or Spheniscus demersus, also known as the jackass penguin for its loud donkey-like braying call. Exactly when penguin diversity in Africa started to plummet, and why, is still unclear.

Gaps in the fossil record make it difficult to determine whether the extinctions were sudden or gradual. "[Because we have fossils from only two time periods,] it's like seeing two frames of a movie," said co-author Daniel Ksepka. "We have a frame at five million years ago, and a frame at 10-12 million years ago, but there's missing footage in between."

Humans probably aren't to blame, the researchers say, because by the time early modern humans arrived in South Africa, all but one of the continent's penguins had already died out.

A more likely possibility is that rising and falling sea levels did them in by wiping out safe nesting sites.

Although penguins spend most of their lives swimming in the ocean, they rely on offshore islands near the coast to build their nests and raise their young. Land surface reconstructions suggest that five million years ago ? when at least four penguin species still called Africa home ? sea level on the South African coast was as much as 90 meters higher than it is today, swamping low-lying areas and turning the region into a network of islands. More islands meant more beaches where penguins could breed while staying safe from mainland predators.

But sea levels in the region are lower today. Once-isolated islands have been reconnected to the continent by newly exposed land bridges, which may have wiped out beach nesting sites and provided access to predators.

Although humans didn't do previous penguins in Africa in, we'll play a key role in shaping the fate of the one species that remains, the researchers add.

Numbers of black-footed penguins have declined by 80% in the last 50 years, and in 2010 the species was classified as endangered. The drop is largely due to oil spills and overfishing of sardines and anchovies ? the black-footed penguin's favorite food.

"There's only one species left today, and it's up to us to keep it safe," Thomas said.

Chevron says executive pay to reflect 2012 "incidents"

(Reuters) - Chevron Corp said on Wednesday its executive pay would reflect certain incidents in 2012 as well as a financial performance that outpaced the U.S. oil company's peer group.

According to the Wall Street Journal, Chevron's board has trimmed equity awards by 11 percent and bonuses by at least 10 percent for Chief Executive John Watson and several other executives as a result of a string of accidents.

A Chevron spokesman declined to comment beyond the statement, which said that despite the company's strong overall performance, it had some "operating incidents" during 2012.

"These incidents were reflected in Mr. Watson's and other senior executives' compensation awards," the statement said.

Just a few months after an oil leak off Brazil in late 2011, a fire burned for weeks at a Chevron well off the coast of Nigeria in early 2012.

Then there was the fire at Chevron's oldest refinery in Richmond, California, which led to damage that has kept the plant operating at reduced capacity for more than six months.

"The board's compensation actions reflect the fact that Chevron takes management accountability seriously," the company said. "Our leadership understands that there are consequences when it doesn't meet expectations, especially in areas as critical as process safety."

Watson earned total compensation of $24.7 million in 2011, including $5.1 million in stock, $7.2 million in option awards and $4 million in non-equity incentives, according to a filing last April with the U.S. Securities and Exchange Commission. The equivalent filing for 2012 is due from Chevron in the next few weeks.

S&P 500 closes at a record high, beating '07 mark

NEW YORK (AP) ? For the second time in less than a month, the stock market marched past another milepost on its long, turbulent journey back from the Great Recession, toppling another record left over from the days before government bailouts and failing investment banks.

The Standard & Poor's 500 closed at a new high Thursday, three weeks after another popular market gauge, the Dow Jones industrial average, obliterated its own closing record. The S&P capped its best quarter in a year, rising 10 percent, and the Dow had its best first quarter in 15 years, climbing 11 percent.

The numbers offer more evidence that investors believe the economy is on the mend, said Sam Stovall, chief equity strategist at S&P Capital IQ.

"The low-flying recovery is gaining altitude," Stovall said, citing a truism among investors that rising stock prices come first, then the economy catches up.

Thursday's performance was driven by encouraging economic data. Companies are making record profits quarter after quarter. They're hiring in greater numbers, and the housing market is finally recovering. The economy has expanded for 14 quarters in a row.

The Fed has helped, too. By keeping interest rates near record lows, the central bank has encouraged people to move money out of savings accounts that pay next to nothing and into stocks and other investments.

Investors warned clients not to get overly excited.

"Getting back to where we were is an important step," said Howard Silverblatt, senior index analyst at S&P Dow Jones Indices. But he cautioned in a note to investors: "Markets are volatile, and if you are a long-term investor you should expect declines."

On Thursday, the S&P 500 rose 6.34 points, or 0.41 percent, to 1,569.19, beating by four points its previous record of 1,565.15 set on Oct. 9, 2007. The index is still shy of its all-time trading high of 1,576.09.

The index has now recovered all of its losses from the recession and the financial crisis that followed. Investors who put their dividends back into the market have done even better. A $10,000 investment in the S&P back in October 2007 would be worth $11,270.

On any other day, a market gain of six points would go unheralded but not after the turmoil that began in late 2008 and persisted through a slow, sometimes stalled recovery.

The S&P 500 is a barometer that gauges market performance. And while professional investors might scoff at using it to decide when to buy and sell, the breaking of an old record can be psychologically important.

However, many obstacles still loom.

The U.S. economy is stable, but growth is anemic. Unemployment is 7.7 percent, versus 4.7 percent, the last time the S&P notched a record. The European debt crisis is far from resolved. And some investors are concerned that the market's gains are being fueled by the Federal Reserve's easy money policy and will disappear once the Fed reverses course.

The crisis of the moment is Cyprus, the Mediterranean island country that struggled this week to get an emergency bailout. For many investors, the bailout deal was a reminder of Europe's lingering economic problems. Elsewhere, Italy failed to set up a new government this week, raising fears that the country will be unable to manage its deep debts.

On Thursday, U.S. economic news was mixed.

The U.S. economy grew faster than first estimated in the fourth quarter, the government reported. But the growth, an annual rate of 0.4 percent, was still weak. The number of Americans seeking unemployment benefits jumped for the second straight week. Longer-term, though, applications for benefits have been declining since November.

In Europe, Cyprus reopened its banks after closing them for nearly two weeks to keep depositors from making panicked withdrawals. Portugal reported that its budget deficit was widening.

"If you're a bull or a bear, you could find enough news out there to convince you of your position," said Jim Lauder, CEO of Global Index Advisors in Marietta, Ga., and co-portfolio manager on Wells Fargo Advantage Dow Jones Target Date Funds.

Brian Singer, partner at William Blair in Chicago, said the market's gains Thursday were more about a lack of any major negative developments than the appearance of any good ones.

"We are looking at a realization that Western civilization is not ending as we know it," Singer said. "Fiscal discussions in the U.S. have settled into an acceptable stalemate. The Italian elections that did not result in a government are on hold. Cyprus hasn't sunk into the Mediterranean."

Thursday marked the end of the first quarter, since markets are closed for Good Friday. Overall, it was a strong quarter.

The Dow climbed for the first 10 trading days of March ? a record not matched in more than 16 years. In the past 10 days, though, it has wavered under the weight of Cyprus.

The Dow rose 11 percent in the first three months of the year, its best quarterly performance since the fourth quarter of 2011. Last year, it lost ground in two quarters and was up by smaller amounts ? 4 percent and 8 percent ? in the other two. On March 5, it beat its own all-time record of 14,164.53, which was also set on Oct. 9, 2007, and has been climbing ever since.

To be sure, the S&P 500's last record was followed by a painful downfall. By March 2009, long after the subprime mortgage market had been revealed as an unsustainable bubble, the S&P had cratered from its lofty heights. On March 9, 2009, it fell to its Great Recession low of 676.53 ? down 57 percent from its October 2007 pinnacle.

With Thursday's gains, it has climbed 132 percent since reaching the bottom. Including dividends, it is up more than 150 percent.

Of course, that also meant he nearly missed his chance at filling in at UFC on Fox 7 after Clay Guida pulled out of his bout with Chad Mendes because of an injury.

Forecast: Twitter's ad revenue to double this year

(AP) ? A research firm expects Twitter's ad revenue to double this year as the online messaging service delivers more marketing pitches aimed at consumers using smartphones and tablet computers.

In a report issued Wednesday, eMarketer projected that Twitter's worldwide ad revenue will climb from an estimated $288 million last year to $583 million this year. In 2014, eMarketer predicts Twitter's ad revenue will approach $1 billon.

EMarketer believes mobile devices will account for more than half of Twitter's ad revenue this year.

The research firm makes educated guesses about Twitter's revenue based on market trends and data. Twitter, based in San Francisco, is privately held and doesn't disclose financial figures.

Twitter hasn't set a timetable for an initial public offering of stock.

Have you ever been in such a rush in the morning that you barely had time for breakfast? Eggs can be a good breakfast choice because they can be cooked quickly and in many different ways. Eggs have been eaten for thousands of years, all over the world. Hard-boiled eggs are commonly used for dying Easter eggs, but a soft-boiled egg can make a yummy breakfast or snack. How does different exposure to heat at different times change the way an egg cooks? In this activity you'll determine the best recipe for producing consistent, soft-boiled eggs that will get your day off to a great start no matter what time of year!

Background
The typical egg packs a big punch in a small package. One large egg has about 75 calories, many essential nutrients, lots of high-quality protein, various vitamins, multiple minerals, choline, folate and riboflavin. Eggs can help you maintain muscle strength as well as promote a healthy brain and eye function. The yolk contains the fat of the egg, most of the vitamins and minerals, and about half of the protein. The albumen (egg white) is mostly water (about 90 percent) and protein (about 10 percent).

There are several methods for preparing eggs. They can be scrambled, poached, fried, pickled, hard-boiled and soft-boiled. In a raw egg the proteins in the egg are folded and curled up tight. But when you cook an egg, the heat causes its proteins to uncurl so that they interact with one another, forming a network of connected proteins. In a soft-boiled egg the white is firm but the yolk is between runny and solid?in other words, the yolk should be viscous, or thickened and sticky.?

Materials
? Three raw eggs
? Pot with lid
? Ice cubes
? Water
? Large bowl
? Stove top (adult supervision is recommended while using the stove and handling any hot items)
? Slotted spoon
? Timer
? Plates

Preparation
? If the eggs are being stored in the refrigerator, take them out and let them warm to room temperature. This may take about an hour.
? Remember to always wash your hands with soap and warm water after handling uncooked eggs because they can carry salmonella. For this same reason, it is not recommended that you eat any uncooked eggs you prepare in this activity.
? Gently place an egg in a pot and add water. Fill the pot so that the egg is covered by about an inch of water.
? Put several ice cubes in a large bowl and fill it with enough water to cover an egg. This will be your ice water bath. If many of the ice cubes melt during the activity, add new ones to the bowl.

Procedure
? Place the pot of water with the egg in it on the stove top, put the lid on the pot and bring the water to a boil. (Please have adult supervision when operating the stove and handling hot items.)
? Once the water is vigorously boiling, let the egg cook for five minutes. Keep the lid on the pot during this time.
? After boiling for five minutes, carefully remove the egg using the slotted spoon and place it into the ice water bath.
? Let the egg sit in the bath for one minute, then remove the egg, peel it and place it on a plate.
? Observe the egg. Is the white firm or watery? How thick is the solid white? Is the yolk slimy, viscous or hard? Overall, does it seem like the egg is soft-boiled?
? Bring the water in the pot back up to a vigorous boil and use the slotted spoon to carefully place a new raw egg into the boiling water. Let the egg boil for five minutes (with the lid on the pot).
? After five minutes, carefully remove the egg and place it into the ice water bath. Let the egg sit there for one minute, then remove it, peel it and place it on a plate.
? Observe the egg. Is the white firm or watery? How thick is the solid white? Is the yolk slimy, viscous or hard? Overall, does it seem like the egg is soft-boiled?

Cousin of Libya's Gadhafi arrested in Egypt

(AP) ? Egyptian security forces arrested a close aide and a cousin of Libya's former dictator Moammar Gadhafi on Tuesday following an hours-long siege of his home in central Cairo, a security official and witnesses said.

Gadhafi's former intelligence official Ahmed Ahmed Qaddaf al-Dam, who is among dozens wanted for their role in Libya's 2011 civil war, surrendered to Egyptian security forces, they said.

Police had surrounded his home in the Cairo neighborhood of Zamalek before dawn. Shots were fired during the siege, but witnesses gave conflicting reports as to whether Qaddaf al-Dam opened fire in the air to drive police away or police had fired the shots as they tried to storm the building. There were no injuries reported.

The official said that Qaddaf al-Dam will be handed over to Interpol to be transferred to Libya. He spoke anonymously because he was not authorized to talk to the press.

Last year, Libya's general prosecutor had requested that Egypt hand over 40 Libyans affiliated with Gadhafi's regime suspected of committing offenses during the eight-month war.

In addition to Qaddaf al-Dam, the list included former Foreign Minister Ali Al-Treki and military intelligence chief Bouzeid Al-Jabou.

During the siege, Qaddaf al-Dam said in a phone call to a private TV channel that he had been invited to Cairo by the military council that took over after the overthrow of President Hosni Mubarak. He described security forces as "a gang."

"We came here with an invitation from the Foreign Ministry and the military council ... We are not terrorists to be ambushed like this," he said. "We will defend our house until the end."

Mubarak, who like Gadhafi was ousted by a 2011 Arab Spring uprising, had close ties to the Libyan dictator. Human rights groups said Cairo allowed Libyan intelligence to kidnap the anti-Gadhafi opposition, notably dissident Mansour Kikhia who disappeared in 1993. Kikhia was said to have later been killed. His remains were located in a house in Tripoli in September.

Even after Mubarak's overthrow, Cairo appeared reluctant to hand over wanted Gadhafi officials, possibly because they had ties with Egypt's intelligence and security apparatus or investments in the country.

The move against Qaddaf al-Dam comes shortly after a visit to Cairo of Libya's Prime Minister Ali Zidan, in which he met with Egypt's President Mohammed Morsi. According to reports in the Egyptian media, Zidan demanded that Egypt hand over wanted men in return for the encouragement of Libyan investment in Egypt and easing the entrance of Egyptian workers to Libya.

Hundreds of thousands of Egyptians work in Libya. Tensions rose in past weeks after Libyan militias arrested scores of Egyptian Christians who were accused of spreading Christianity. After their release, the Christians said they were tortured while in detention. Egypt's Foreign Ministry protested the arrests and Christians demonstrated outside Libya's embassy in Cairo.

Pelosi Stretches an Old McConnell Quote

Rep. Nancy Pelosi seized on an old talking point, miscasting a now-famous quote by Senate Republican Leader Mitch McConnell in 2010 about the goal of making Obama a ?one-term president.?

On CNN?s ?State of the Union? on March 10, host Candy Crowley asked the leader of the House Democrats if President Barack Obama?s stated commitment to helping return the House to Democratic power, with Pelosi at the helm, wasn?t the same as McConnell?s comment about his goal of making Obama a one-term president. Crowley was referring to comments Obama made at the House Democratic Issues Conference on Feb. 7 in which he praised the work of Democratic elected officials and concluded his remarks by saying, ?And as a byproduct of doing that good work and keeping that focus, I would expect that Nancy Pelosi is going to be Speaker again pretty soon.?

Crowley: Isn?t that kind of the same thing?

Pelosi: No, it is completely different, but thank you for the question. It?s completely different, because when Mitch McConnell said that, he was talking about stopping, obstructing initiatives to create jobs, stopping initiatives that would show bipartisanship on the part of the president.

He wanted to show ? they want to show that he couldn?t come to agreement with the Republicans simply ? it didn?t matter what the subject was, they were not going to support it.

Although McConnell?s comment was often cited by Democrats during the 2012 campaign as evidence of Republicans? refusal to compromise as a strategy to regain the White House, a review of McConnell?s fuller comments suggests Pelosi and others read more into McConnell?s words than was actually said.

Here?s what McConnell said in an Oct. 23, 2010, Q&A interview with the National Journal just prior to the midterm elections.

McConnell: We need to be honest with the public. This election is about them, not us. And we need to treat this election as the first step in retaking the government. We need to say to everyone on Election Day, ?Those of you who helped make this a good day, you need to go out and help us finish the job.?

National Journal: What?s the job?

McConnell: The single most important thing we want to achieve is for President Obama to be a one-term president.

National Journal: Does that mean endless, or at least frequent, confrontation with the president?

McConnell: If President Obama does a Clintonian backflip, if he?s willing to meet us halfway on some of the biggest issues, it?s not inappropriate for us to do business with him.

National Journal: What are the big issues?

McConnell: It is possible the president?s advisers will tell him he has to do something to get right with the public on his levels of spending and [on] lowering the national debt. If he were to heed that advice, he would, I imagine, find more support among our conference than he would among some in the Senate in his own party. I don?t want the president to fail; I want him to change. So, we?ll see. The next move is going to be up to him.

McConnell?s fuller comments ? including the vow to work with Obama ?if he?s willing to meet us halfway on some of the biggest issues? and his statement that ?I don?t want the president to fail; I want him to change? ? contradict Pelosi?s claim that McConnell was speaking in the context of opposing any bipartisan initiatives or that he was outlining a position that Republicans would not support the president no ?matter what the subject was.? One can argue about whether that turned out to be a Republican strategy or not, but that?s not what McConnell said.

In a speech at the Heritage Foundation just after the 2010 midterm elections, McConnell expanded on his comments:

McConnell, Nov. 4, 2010: Over the past week, some have said it was indelicate of me to suggest that our top political priority over the next two years should be to deny President Obama a second term in office. But the fact is, if our primary legislative goals are to repeal and replace the health spending bill; to end the bailouts; cut spending; and shrink the size and scope of government, the only way to do all these things is to put someone in the White House who won?t veto any of these things. We can hope the President will start listening to the electorate after Tuesday?s election. But we can?t plan on it.

In other words, McConnell was making the point that in order for the Republican Party to achieve the majority of its agenda, it would have to regain the White House. And Obama was making the point that voters would reward Democrats at the polls, if the party gets a chance to achieve the majority of its agenda. We leave it to the reader to judge how similar, or not, the statements by McConnell and Obama are. The fact is, without full control of Congress and the presidency, neither side can get everything it wants.

Protein abundant in cancerous cells causes DNA 'supercoiling'

A team of USC scientists has identified a protein that can change DNA topology, making DNA twist up into a so-called "supercoil."

The finding provides new insight about the role of the protein?known as mini-chromosome maintenance (MCM)?in cancer cells, which have high levels of MCM.

Think about twisting one end of a rubber band while holding the other end still. After a few turns, it forms a neatly twisted rope. But if you keep on turning, the twisted band will twist back upon itself into an increasingly coiled-up knot. Similarly, a DNA molecule can be twisted and coiled to varying extents to form different "supercoiled" structures.

Chromosomal DNA forms different supercoiled structures to enable a number of important processes. It turns on or off some genes, while tuning up or down other genes. The study suggests that an overabundance of MCM in a cell may allow certain genes to be overexpressed, and tune down or turn off other important genes, causing the cell to grow out of control and become cancerous.

Chromosomal DNA structure is very important for regulating gene expression of a cell, and thus the physiological status of the cell. Changing DNA topology is one effective way of controlling chromosomal DNA structure. The discovery of MCM's ability to change DNA topology offers a totally new perspective to MCM's role in gene regulation and cancer," said Xiaojiang Chen, professor of molecular biology at the USC Dornsife College of Letters, Arts and Sciences, and corresponding author of the study.

Chen worked with fellow USC professor Susan Forsburg and USC graduate students Ian M. Slaymaker, Yang Fu and Nimna Ranatunga; as well as Daniel B. Toso and Z. Hong Zhou of UCLA and Aaron Brewster of UC Berkeley. Their study was published online by Nucleic Acids Research on Jan. 29.

Chen and his team found that MCM proteins form a filament that looks much like a wide tube, through which the DNA strand spirals its way along the inner tube wall. Inside of the tube is a wide spiral path that has a strong positive electrical charge.

"Such a striking feature is unusual," said Chen. Who is also a member of the USC Norris Cancer Center. "When you see that, you know it must have a special function." Indeed, it turns out that the positively charged spiral path attracts and binds to the DNA strand, which has a negatively charged phosphate backbone.

Holding the DNA tightly to the spiral path inside the helical filament tube causes the DNA double-helix to change structure, creating supercoils. Future research by the team will explore how the DNA topology changes caused by MCM impacts cancer cell formation as well as its utility in cancer therapy.

HTC responds to reported European HTC One delay

HTC One

UK retailer Clove Technology is reporting that the flagship HTC One's European launch has been held back to Mar. 29, two weeks later than Clove's expected date of Mar. 15. Though HTC has not publicly announced a specific release date for the phone in any territory, Clove insists it's been "officially informed by HTC UK."

We've reached out to HTC, which has provided us with this statement on HTC One availability --

"We will start fulfilling pre-orders by end March in certain markets and will roll out to more markets as we approach April."

That's almost exactly what we were told around the launch event in February, so it appears little has changed from the manufacturer's perspective.

So we'll have to wait and see when the HTC One eventually becomes available in Europe, but we imagine that wait shouldn't be a long one. O2 Germany, for example, is already shipping the HTC One on contract, so we wouldn't discount the possibility of devices showing up for sale elsewhere before the month's end.

Specific details on U.S. availability are still unavailable -- we suspect we'll be waiting on announcements from individual carriers.

Following up on a user interface update last month, the most excellent Rdio subscription music app has been updated with a few new features. For one, social listening has been included, so you can see what your friends are listening to on Rdio, just like the web application. Also, you can switch to a full screen mode when streaming tunes, so you can soak in the album art - perfect for when your iPhone or iPad is docked.

I'm a huge fan of Rdio, and if I wasn't already enamoured with Songza, it would be where I get my daily dose of music from if I wasn't such a cheapskate.

Omniture Co-Founder's Business Intelligence SaaS Company Domo ...

Domo, the SaaS business intelligence startup launched by Omniture founder Josh James, has raised $60 million in new funding, we?ve learned exclusively. The round was led by GGV Capital with Greylock Partners; Bezos Expeditions, the personal investment company of Jeff Bezos; co-CEOs of Workday Aneel Bhusri and David Duffield; Founders Fund; and Mercato Partners all participating.

In addition, IVP and Sorenson Capital?s Fraser Bullock, previous investors who were the first to commit to this round, doubled down, we?re told. BYU?s student-run venture fund, Cougar Capital, also participated and Aneel Bhusri and GGV partner, Glenn Solomon, will become Domo board observers. Domo previously raised $63 million from Institutional Venture Partners, Benchmark Capital, Andreessen Horowitz, SV Angel, Marc Benioff, SuccessFactors founder Lars Darlgaard and Hummer Winblad. While the valuation in the round was not revealed, James said the jump was ?meaningful enough to take the dilution of stock.?

Omniture is a web analytics SaaS company that went public and was subsequently bought by Adobe in 2009 for $1.8 billion. In 2011, James debuted Domo, with $33 million in funding from Benchmark tackling the business intelligence space. Domo has also purchased a company in the past called Corda.

Domo has been relatively quiet about its product, besides to announce the funding. In fact, Domo has yet to be released to the public. So what does Domo do? The company puts BI in the cloud, but in a scalable and easy-to-use format so people can actually make sense of (and make money off of) massive amounts of business data. The application is able to analyze business data and display it in a user-friendly and realtime format.

After selling for only six months, Domo already has more than 100 revenue-generating enterprise customers across numerous industries, including media and marketing, telco, retail, travel and leisure, technology, financial services and professional services.

And James isn?t shy about his goals. ?We want to do what the iPhone did for mobile to the enterprise world,? he says.

Domo is for the CEO | DomoGlenn Solomon, partner at GGV, explains that the firm had a tremendous amount of respect for what James did at Omniture, but Domo?s product has also gotten them really excited. Between the company?s fast growth, the revenue and addition of new customers, it?s an extremely attractive business that?s ?way ahead of the game.?

James tells us that the software as a service takes all the data in an organization and puts it into a platform that allows you to interact with data in a way executives have never been able to do. ?Domo eliminates meetings, creates data intelligence, and turns that data into real information that users can share and collaborate on,? he says.

For example, a Fortune 500 retailer is using Domo to see what colors of products are selling in realtime, and adjusting manufacturing and supply chain management in real time. James says that prior to using Domo, the company had to wait months to analyze sales data and then make changes in other business areas.

The product will be coming out of private beta in the coming year.

?I met Josh in 1998 and was one of his first investors in Omniture,? said Fraser Bullock, co-founder and managing director at Sorenson Capital and co-founder of Bain Capital. ?Domo has a much larger addressable market than Omniture because it is focusing on executives across the organization. Given Josh?s track record and the experience of the team he?s assembled, I couldn?t be more bullish about Domo?s prospects to become one of the most transformational enterprise software companies in history.?

Todd Chaffee of IVP agrees. ?Josh is built to build successful software companies?you can sense that certain companies that have the magic and this one feels like a really big one.?

As for why James decided to raise funding at this point, he says he?s ?strengthening the balance sheet in preparation for our next phase of growth.? But when starting the fundraising process, investor interest was overwhelming, and the company raised twice the amount they intended to raise. In fact, Domo ended up turning away more than $50 million in additional funds for this round.

The funding is mainly going to be used to hire for sales and engineering. ?We can be the size of what Omniture was when the company went public in 12 months,? James says. ?We?re going to make the most significant enterprise tech company since Salesforce.?

?I want some freaking sales reps,? concludes James.

Marvel releasing some 700 No. 1 issues digitally

In comics, the first issue is where the story starts and the legend begins.

For readers, a print copy of issue one can be hard to find and expensive to buy. But those rules don't apply to tablets, laptops and smartphones both for comics fans and those curious about characters they may have seen in film or on television.

Part of that fascination with superheroes and their growing cachet in popular culture is why Marvel Entertainment, home to the Fantastic Four, the X-Men and the Avengers, among others, is making more than 700 first issues available to digital readers starting Sunday for free through the Marvel app and the company's website. After Tuesday, they'll be sold for $1.99 to $3.99 per issue.

The titles go from the 1960s Silver Age to contemporary issues with characters including Wasp, Mr. Fantastic, Power Man and Iron Fist, said David Gabriel, senior vice president of sales.

"This is aimed at attracting fans from all walks of life ? those who know our characters from the big screen, those who were readers but fell out of the habit and our long-term fans too," he said. "We believe that if we get those fans in the door, they'll stay and help grow this industry, with purchases both in comic stores and via digital comic outlets."

The publisher went through its catalog of more than 13,000 titles that are already available digitally and plucked out the No. 1 issues with historic ones like "Amazing Spider-Man" by Stan Lee and Steve Ditko or the "Fantastic Four" by Lee and Jack Kirby as well as modern titles like "Civil War," Joss Whedon's "Astonishing X-Men" and characters and teams like the Uncanny Avengers and Guardians of the Galaxy, too.

"We never want fans to feel like they need to have read it all. Of course we want them to want to check out those stories, but the beauty of these No. 1 issues is that each is an entry point," he said. "So with a character like Iron Man, you can choose if you want to start with the recent 'Iron Man' series from Kieron Gillen or go back a few years to when Matt Fraction launched 'Invincible Iron Man' or even before that."
